Alarming increase in complaints

The NYPD has received 378 complaints of public masturbation so far this year, compared to 251 in the same period in 2023. Officers have issued 159 summonses to individuals caught exposing themselves, a staggering 396% increase from the 32 tickets issued last year.

Residents voiced their concerns about the escalating situation during a meeting for Manhattan’s Community Board 1 last month. Frustration grew as police failed to respond effectively to their complaints.

Legal consequences and challenges

Under New York’s indecent exposure law, lewdness, including exposing oneself to masturbate, is punishable by up to 90 days in jail, a $500 fine, and probation. Public lewdness in the first degree is classified as a Class A misdemeanor, carrying a potential sentence of up to one year in jail and a $1,000 fine. Exposure is considered a violation, with penalties including up to 15 days in jail, fines, and community service.

Despite these legal repercussions, law enforcement officials are skeptical about the effectiveness of these penalties. “This is a desk appearance ticket and a non-bail eligible offense, so he will be out within two hours,” said Captain Joel Rosenthal, commanding officer of the First Precinct.

Systemic issues and contributing factors

For years, New York City has been advocating against incarceration, making it challenging for officers to deter offenders. Additionally, experts point to the ongoing migrant crisis as a contributing factor to the city’s law and order problems. Since the spring of 2022, over 200,000 migrants have entered New York from the southern borders.

A report published in June highlighted that approximately 16,000 former hotel rooms in New York had been booked to accommodate the influx of migrants. This situation has further strained the city’s resources and exacerbated the issue of public lewdness.
